Do beneficiaries have to pay creditors out of their own pocket for an insolvent estate?
Attorney Gadi Zohar explains:
The short answer is no. A beneficiary should never have to pay anything out of their pocket when an estate is insolvent.
If an estate is insolvent, there is a particular process for administering that estate. It can still go through probate. But in any case, there won’t be a situation where a beneficiary has to pay out of their pocket unless they received some of the decedent’s property that should go toward that debt somehow outside the probate. They may have to pay back some of the property they received, but it should never come out of the pocket of a beneficiary. Any debts, or only debts that can be taken out of the decedent’s assets.
