Do IRA’s go through probate?
Attorney Gadi Zohar explains:
Generally, an IRA, also known as an IRA do not go through probate. However, sometimes they do end up going through probate. If somebody did not leave a death beneficiary, or what often happens is somebody leaves only their spouse is a death beneficiary, but then if their spouse predeceased them, there may not be another death beneficiary.
And in those cases, IRAs or 401k’s, which fall into the same categories, do end up needing to go through the probate process.
