You shouldn’t have to pay any probate fees or cost out of your pocket at all. Many attorneys will ask you to deposit some of your personal money in order to cover the initial expenses of a probate. We do not. We will front the probate costs upfront and then get reimbursed from the estate.

In general, the rule is whatever expenses are associated with the probate, need to come entirely out of the probate estate. They shouldn’t be coming out of your pocket at all.
