Why might a guardian ad litem be necessary during probate?

Attorney Gadi Zohar explains:

A guardian ad litem be necessary usually when there’s a minor child who’s involved in the probate process. An adult who’s a beneficiary of an estate can make decisions for themselves.

For example, a common decision that an adult would make would be to waive notice requirements or waive the requirement for an accounting or even reviewing an accounting and making sure that everything looks fine in the accounting. A child can’t do that. So the court assigns an attorney who is, a neutral party to act on behalf of the child and step into the child’s shoes and make sure that the child’s rights as a beneficiary are being respected.

In other cases, it could be a disabled adult who, needs a guardian ad litem, and that’s all the same applies to a disabled adult as a child.
