What is a holographic will?
Attorney Gadi Zohar explains:
A holographic will is a handwritten will written in the handwriting of the decedent. It has to be entirely in their handwriting, and it has to be signed by the decedent. The requirements are not particularly strict, except at the point where you’re admitting a holographic to will into probate. You do have to, present some sort of documentation that confirms that the will, was written in the decedent’s handwriting and signed by the decedent.
They are valid. A more updated holographic will will supersede a previous will. There is no such thing as a will being more valid because it was typed out as opposed to being holographic. It’s important if you’re going to rely on admitting a holographic will in the probate, it’s a good idea to have an experienced probate attorney to help you through the process. It can involve a few extra steps.
