I’m going to be frank with you. Probate is a very difficult process. Even a smooth probate is very difficult to manage. An experienced probate attorney, and I would say you don’t only need a probate attorney, you really need an experienced probate attorney because there is no other way to learn about probate. There are no classes. There’s nothing you can do other than have experience in managing a probate.

An experienced probate attorney is going to know how to navigate the system. Oftentimes I’ve had clients who can’t even they try to do it on their own and can’t even file that first petition in the court. So a probate attorney is going to make sure that you administer, first of all, that you’re able to administer the estate in any kind of a timely manner, and then secondly that you do it according to the law because if you administer the estate and don’t do it according to the law, you could be held personally liable by taxing authorities or other agencies, and so having an experienced probate attorney is in my opinion essential for probating an estate.
